The ATO expects all tax returns to be filed by October 31st each year. However, as long as you’ve made an appointment with a DigiTax accountant before October 31st, you’ll have until sometime in May (the exact date differs year to year) to complete your tax return.

If you’ve already missed this date, the ATO may apply a penalty for failing to lodge your taxes on time. The good news is that the ATO generally does not apply this penalty if you meet the following criteria:

• You lodged your overdue tax return voluntarily (i.e. no warning letter has been issued)
• There was no tax payable for your overdue tax return

The less exciting news is that if you meet any of the below criteria, the ATO is more likely to apply the late lodgement penalty:

• You have two or more overdue tax returns
• You have a poor track record of lodging your taxes on time
• You have been prompted to lodge your tax return and have failed to comply

While it’s tempting to keep putting your taxes off, it’s crucial to understand that the Failure to Lodge (FTL) penalty continues to accrue every 28 days. The ATO may also apply a General Interest Charge (GIC) to any taxes owed after the due date. If a Default Assessment Warning Letter (DAWL) is issued, failure to comply can lead to additional administrative penalties.
